Social networking sites are great for society, promoting increased communication and connection between hundreds of millions of people throughout the world. While some people do argue that the dangers of online networking far outweigh the benefits, it is clear that this is not the case; rather it is the other way around. Online social networking can be broadly defined as any website or other type of online communication that allows people to interact with each other. Blogging, or keeping an online journal, first became popular in the late 1990’s. As blogging began to appeal to more and more people, pure social networking sites appeared. Unique displays of art, music, and writing can be found everywhere on these sites - no two profiles are exactly the same. They are a way to express yourself, and show the world how you really feel about life. Since, the entrance of foreign enterprises in China, SOE employees are attracted to foreign firms because of personal development through training as well as better pay packages and working environment. Foreign enterprises in China face challenges such as high training and development cost of employees and adhering to the labour laws of China. The employee turnover rate in China was 18.5% in 2010 for privately owned companies. The Chinese system can still be classified as bureaucratic and rigid. Structure of an Interview A structure for an interview for Interpreter/translator position at school district should be very specific. I would include in the posting of the job the following specifications: * Position/Title * Location * Director Supervisor * Qualifications I would include in the qualifications certification, fluent in oral and written Spanish and English, ability to work with teachers, administrators, parents, and students. As an interviewer a will ask the applicant to talk a little about effective practices she/he used in the past when she/he are needed in two places at once. This scenario deals with multi-tasking, I want to make sure the applicant can deal with situations under pressure when you are working with parents, students, and teachers. Scenario #2 â€Å"You are interpreting for a non-English speaking parent, when an urgent situation in a classroom-involving an ELL student occurs. What would you do? As a school district job, the most important thing is the being well of the students. The interpreter must care about the children first. I also will ask the following questions: 1. – Tell a little about yourself-why you are interested in this position, your interests, previous experiences etc. 2. What training or coursework you have participated in during the past two years? 3. -What you bring to this position that would enhance our school district? 4. -If you were offered this position, when would you be able to begin? 5. -What are your current/minimum salary requirements? I feel that the questions above are job related, because even though I have the applicant’s resume by asking questions like tell a little about yourself you I can kind of see she/he personality. Most of the companies like people that like to learn new things or be familiar with new regulations or could be that they haven’t participate in any training is a result of lock of opportunity, money etc. For the third question, I want to know why they think they can be a good candidate, what they can bring to the company that makes them the best candidate for the position. As an interviewer you need to know when they can start working and for the last question, they do not have to answer about their current salary but I think to know what is the minimum salary require is a valid question. Answer: Introducation Law: the first requirement of valid contract is an agreement, and agreement for this purpose includes offer and acceptance. However, it also includes intention to create legal relations between the parties and consideration. Therefore, contract exists between the parties, and Sharon can claim for breach of contract, but this claim can be defended by Ben by using the defense of unilateral mistake. Under this defense Ben can seek remedies of rescission or rectification, business conduct of the Sharon was also improper as she fails to read the terms of the contract. Conclusion: in this case, Sharon can claim for breach of contract because contract exists between the parties, but Ben can cancel the contract by using the defense of unilateral mistake. Issue: Whether Gordon has right to rescind the contract on the basis of misrepresentation, and who has better claim to the car Cheng or Gordon? Law: misrepresentation is considered as false statement, which is made by representator related to any fact or law for the purpose of induces the representee to enter into contract. Misrepresentation occurs when three essential elements are present: Representation must be related to present or future fact. Representation made by representee must be false. Application- in the present case, contract between Gordon and Mary was entered on the basis of misrepresentation, but Gordon cannot rescind the contract because his right to rescind the contract is no more available. His right to cancel the contract is no more available because third party (Cheng) acquires the right in the contract and Gordon fails to take reasonable steps which show that he does not intend to bind with the terms of the contract. This can be understood through case law Car Universal Credit v Caldwell [1964] 2 WLR 600. In this case, Court held that right of Mr. Caldwell to rescind the contract was available, even though third party acquires the right. Mr. Caldwell took all steps to show that he does not intend to be bound by the terms of the contract. Therefore, Gordon cannot rescind the contract, but only claim for damages from the Mary.
